These Terms apply to the Site only. Your use of the Verigrey platform, products, or testing services is governed by a separate written agreement between you (or your organization) and Verigrey. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD 100).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation).
You agree to indemnify, defend, and hold harmless Verigrey and its directors, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with your breach of these Terms or your misuse of the Site.
These Terms, and any dispute or claim arising out of or in connection with them or the Site (including non-contractual disputes), are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. The state and federal courts located in Delaware shall have exclusive jurisdiction, and you consent to that jurisdiction and venue.
